Verification of Special Jurisdiction for Peace Restorative Sentences

 

Role of the UN Verification Mission 

On 11 May 2021, the UN Security Council expanded the mandate of the UN Verification Mission in Colombia to verify compliance with the restorative sentences from the Special Jurisdiction for Peace (SJP), contained in Point 5.1.2 in the Peace Agreement. 

 

What will the UN Mission verify with regards to restorative sentences?

  • That those sanctioned comply with the restorative sentences.
  • That the state authorities establish the necessary conditions for the implementation  of the restorative sentences.

To this end, the UN Mission will:

  • Monitor the general trends with restorative sentences compliance.
  • Follow up on individual cases of special interest.

 

What will the UN Mission not do in terms of the restorative sentences work?

  • The Mission will not finance the restorative sentences system.
  • The Mission will not implement the restorative sentences; this is the responsibility of national entities.
  • The Mission will not make assessments of judicial decisions.

The SJP is found within the Comprehensive System of Truth, Justice, Reparation and non-Repetition (SIVJRNR). The SIVJRNR is a set of mechanisms which guarantee the rights of victims to truth, justice, redress and non-repetition which are stipulated in the 2016 Peace Agreement between the Colombian Government and the extinct FARC-EP. 

The SIVJRNR is made up of the SJP, the Truth, Coexistence and Non-Repetition Commission (CEV), and the Unit for People Deemed Missing in the context and for reasons of the armed conflict (UPBD). 

What is the mandate of each component of the Comprehensive System of Truth, Justice, Reparation and non-Repetition?

The Special Jurisdiction for Peace (SJP)

The SJP is responsible for investigating, judging and punishing the most serious and representative crimes that occurred in the armed conflict, which are prioritised by the SJP. 
 

The truth, Coexistence and Non-Repetition Commission

The CEV listened to actors from the armed conflict, victims and institutions, and published a final report with the findings on the structural causes of the armed conflict, as well as the recommendations for non-repetition.  


The Unit for People Deemed Missing

The UPBD leads and coordinates the search for all missing persons, whether they were victims of forced disappearance, members of armed groups, military and civilians who disappeared, those who died in the framework of the hostilities, and persons deprived of their liberty who subsequently disappeared in the context of the conflict.
